小心「美國綠卡」被取消，離境太久會被警告

美國新的US-VISIT電腦除了確認訪客的身份外，逐步記錄在各機場實施的「出境資料」，確定他們是否遵守移民法令的規定。以往美國旅客出境不需經過移民局檢查就離開的大漏洞，現在已越來越難過關。

最該注意的是綠卡是否過期：離境超過半年、綠卡效期已到、白皮書到期....等。都可能被取消，目前只要離境4個月以上，護照大都會被記錄「AVD RES REQ」的警告，下次入境就會嚴查。

美要逃稅名單瑞銀投降

美國「外國帳戶稅收遵從法」（ＦＡＴＣＡ）要到二○一三年一月才生效，但美國政府近年來已透過法律途徑，逼使有「避稅天堂」之稱的瑞士政府和全球第二大財富管理業者瑞士銀行（ＵＢＳ）乖乖就範，交出有逃稅嫌疑的美國客戶名單。

美國參院在二○○八年七月指控包括瑞銀在內的一些瑞士銀行協助美國富人透過海外帳戶逃稅。同年十一月，美國大陪審團起訴瑞銀的全球財富管理與商業銀行董事長兼執行長魏爾，迫使瑞銀與魏爾斷絕關係，並在二○○九年二月與美國政府就共謀詐欺刑事案件達成庭外和解，同意付七億八千萬美元罰款。

但在雙方達成和解的同一天，美國政府又對瑞銀提出民事告訴，要求瑞銀交出五萬二千名美國客戶名單，指控瑞銀和這些客戶共謀詐欺美國國稅局。

瑞銀、美國政府和瑞士政府二○○九年八月達成和解，同意瑞銀交出逃稅嫌疑最重的四千四百五十名美國客戶名單，帳戶資產達一百八十億美元。由於瑞銀交出客戶名單，違反瑞士的銀行隱私法，瑞士國會直到二○一○年六月才通過法案，同意將有逃稅嫌疑的美國客戶資料和帳戶明細交給美國。

美國政府乘勝追擊，美國大陪審團正準備向十二家瑞士銀行與在瑞士有分行的國際銀行開出傳票，要求交出有逃稅嫌疑的美國客戶名單，被點名的有瑞士信貸和匯豐銀行。媒體報導，美方鎖定二○○二年到二○一○年存款五萬美元以上的客戶。

美國已決心把瑞士的成功案例，用到其他國家。

銀行業不滿：侵犯自主盼金管會hold住

為防堵美國公民逃漏稅，美國擬要求金融機構提供銀行內大戶資料，台灣金融機構指出，這項措施雖然不是針對台灣，但侵犯了各國的金融自主權，如同「割地條款」，希望金管會「hold住」、「不要軟骨頭」。

金管會銀行局局長桂先農昨天說，這項條款還沒有執行，但對各國影響都很大，其他國家也都有不同的意見，金管會已透過公會，向美方反映。

銀行業人士說，肥咖條款雖然二○一三年才實施，金融機構如要配合作業，至少需要約一年的事前準備，時間相當緊迫，金管會至今沒有明確表態，國內金融機構都十分著急，希望政府日拿出對策，業者有所適從。

「有錢人想要拿綠卡，一定要勸他三思！」資誠會計師許祺昌透露，很多客戶抱怨，有銀行開始不接受以「美國人」身分開戶，有帳戶的人未來也難逃查稅。

另一位會計師說，從個別金融機構的角度來說，銀行如果（和美方）簽約的話，資料被外洩的客戶，可根據台灣現行個人資料保護法的規定，在台灣提起訴訟，控告銀行。

大型銀行主管也強調，美方態度強硬，看來勢在必行，一般民營銀行恐怕無法獨力對抗，主管機關在處理這件事情上，「要有擔當」，「凡是有主權概念的國家，都不會放任自己家裡（境內）金融機構，對國外政府（美國）提供客戶資料。」

美霸道查稅掐住金融機構

美國政府宣布將實施「肥咖條款」，引起全球金融業震撼。有外國金融業者上美國國稅局的網站，大罵美國此舉「流氓霸道」。美國國稅局的回覆是，「如果這些都是你們國家的納稅人，我們想，你們也會這麼做。」

美國政府全球查稅，這次似乎是「玩真的」。許多金融機構預期「肥咖條款」會再修改或延期。但專家說，美國全球查稅、追稅的風氣已是「主流」，沒有一位美國國會議員敢站出來反對這個法令，美國政府「不可能不做」，只有如何執行的問題。

另外，肥咖條款厲害之處在於，美國政府並不直接規範全球各地的美國人，而是「掐住」所謂「中間機構」的命脈。

「中間機構」即全球銀行、壽險、投信及證券公司，這些公司因為有投資美國部位，或在美國設立據點，如果不接受肥咖條款，不跟美國簽FFI（外國金融機構合約），就變成未來「自己要繳稅」。

若金融業不願就範，未來只要有美國市場的所得，就要被美國政府扣百分之卅的稅。肥咖條款甚至還搞「同儕」懲罰效應，即金融機構間都會互相往來，但其中若有一家沒跟美國簽FFI，未來各公司若再跟這家公司進行「同業」付款或拆借，只要跟美國來源所得有關，美國也要扣百分之卅的稅。

安永會計師事務所協理高旭宏說，很多金融機構會評估，有沒有必要幫美納稅人「瞞他應報給美國的稅」。若外商金融保險集團，全都實施肥咖條款，台灣金融業因須與這些公司來往，也必須接受。

美釘「肥咖」追稅逼全球當眼線

美國政府祭出「肥咖條款(ＦＡＴＣＡ)」大追稅，要求全球廿萬家金融機構，包括台灣在內，充當「眼線」、「抓耙子」，向美國國稅局通報海外美國人的金融資料；台灣銀行公會日前回函美方，表達「此舉恐違法」，並未具體回應配不配合。

金管會銀行局局長桂先農說，ＦＡＴＣＡ爭議不小，而且違反許多國家法規，美國應該尊重其他國家的意見，金管會隨時掌握最新動態，並與其他國家採取同一步調。

據了解，銀行公會日前在金管會授權下，代表台灣金融業回函美國國稅局與財政部；銀行公會在函中表示，ＦＡＴＣＡ條款違反台灣銀行法及個人資料保護法，執行面上恐有困難。

銀行公會回函長達八頁，除了陳述執行困難，也提出建議，例如提高通報門檻，五十萬美元存款提高至一百萬美元等，同時強調希望參與法規諮詢與討論。

ＦＡＴＣＡ全名為「外國帳戶稅收遵從法」，美國會於今年六月通過，針對全球有錢、但可能沒有誠實申報的美國人查察，國內金融業把這項法案稱為「肥咖條款」。

依「肥咖條款」規定，美國稅局可與全球金融機構簽訂ＦＦＩ（外國金融機構合約），從二○一三年七月起，簽約金融機構負有「判別潛在美國人」責任，美方鎖定特定條件、例如存款超過五十萬美元的帳戶，金融機構必須複查是否為「美國人」帳戶。

另外，簽約金融機構裡的「財富管理及私人銀行」的客戶，無論這些客戶存款多寡，都必須向美國政府通報，有沒有美國人的帳戶。

換句話說，與美方簽訂ＦＦＩ的金融機構，就像是美國國稅局在全球眼線、或「抓耙子」，透過這些金融機構，美國政府海外查稅將事半功倍。

值得注意的是，「肥咖條款」附加懲罰規定，金融機構如果不簽ＦＦＩ，今後這些金融業的特定美國來源所得，將被美國課徵三成的所得稅。

全球金融業對「肥咖條款」反應激烈，抨擊美國政府「侵門踏戶」，違反各國銀行保密法規定，簡直就不把其他國家法律當回事。但據了解，目前除美系金融業可能全數接受「肥咖條款」，歐系金融業，例如匯豐集團也考慮接受。
